Stimulus payments

Good Afternoon CHild Support!!

I hope that this finds you all in good health. I am wondering how you are all disbursing monies that come from the stimulus payment? Is any tribes have any issues with this? We are running into a few cases where stimulus monies are being taken from the NCP shares for dependents.

  1. The State of Wisconsin, which are the rules Lac du Flambeau Tribe follows to a certain extent, has declared the stimulus payments as income and were intercepted from any NCP that had any debt, needless to say there are not many happy NCP’s. 😮

  2. In some cases the FTI has satisfied the majority of the debt for some of our people and we have to issue a refund for the remainder but that really isn’t a problem. We have a lot of angry people calling about the stimulus payment being taken. We just explain that the IRS set it up that way and we can’t do anything about it. They aren’t happy but when that is explained to them they calm down.

  3. We have an agreement with WA state to intercept the IRS payments for us. States should have some type of process to give NCP an opportunity to request some or all of it back due to hardships. This could be done in an Admin review or through a Court order. For us, if an NCP is requesting some or all of the $ back then they would need to go to Tribal Court.
